I just heard the segment and the issue here is consent. Many excellent examples were provided in the story that, for me, constituted rape (w/o force) through the use of fraud. Keep in mind that just BSing your way into the sack should not get you in jail but assuming the identity of another person may be enough. One of the better examples was one of the college party where one dude gets first and then leaves covered up and then some other guy comes back in wearing the same guise and takes a turn. That to me is equivalent to rape, however a distinction must be made similar to the different sub-types of other crimes.
