non motorized vehicles do have the right of way. they are suppose to ride on the right hand side as much as possible, but there is no law that says they have to in most states. it is their choice. in most states they do have the right of way over motorized vehicles regardless were they are. if you think i’m wrong then cite the code.
this is different. it wasn’t him following to close it was a vehicle illegally passing and hitting at the same time. if they had came up to the vehicle and hit it then it would be another story but the vehicle was passing at the time when the accident happened and the accident was intentional. as far as i know if you get rear ended there are only 2 ways it is your fault and this is one of them.
again, they where not following because they where being passed illegally, so how close they where to the vehicle has no reasoning.
